O novo procurador-geral de Justiça, Rodrigo Fonseca Costa, defende uma discussão ampla sobre o cumprimento imediato e efetivo das penas no Brasil. Segundo ele, as vezes sentenças de mais de 30 anos de prisão “são bonitas” para sociedade, sendo que fato o condenado já tem conhecimento que ficará tempo menor na cadeia.
Em entrevista à imprensa, concedida na última quinta-feira (06.02), Fonseca acredita que o Congresso Nacional precisa de fato abrir uma discussão transparente sobre uma reforma na legislação penal, principalmente sobre a forma que é estabelecido o modelo redução.
“O que acho negativo na legislação brasileira e é uma opinião pessoal: É 10 anos, o cara cumpre 1/2 preso. Em alguns crimes, você poderia reduzir, não tem problema. Por exemplo, você tem um furto, era para cumprir 1 ano, mas cumpre 6 meses preso. Eu acho que essa é a discussão: a forma do cumprimento da pena. O semiaberto e o aberto no Brasil não servem. Estamos com dificuldade com esses regimes”, declarou o procurador.
Em outro ponto ele acrescentou: “Essa discussão tem que ser transparente porque número as vezes é bonito; olha é 30 anos, é bastante, ninguém vai ter coragem de dizer que é pouco, mas ninguém falou que vai cumprir 5 anos, aí fico pouco!”
Segundo ele, é preciso que alguns casos sejam resolvidos no Direito Administrativo, sem necessidade de resultar em ação penal em decorrência da “simplicidade do fato”. O procurador citou como exemplo o racha de veículos, a qual, segundo ele, pode ser resolvida com apreensão da CNH e dos carros.
Além disso, citou a questão do som alto, crime de poluição sonora, que pode ser resolvido com aplicação de multa. “Não precisa de casos como estes virarem ação penal. Pode ser resolvido no Direito Administrativo”, defendeu Fonseca.
